“Fatal Frontier” is a proprietary interactive entertainment software product (“Game”), enabling users to use virtual assets within the Game. The Game is published and developed by Paydirt Games Inc. (“Paydirt” “we” “us” or “our”). This Privacy Policy applies to your use of the Game and www.paydirtgames.com, the website from which we publish the Game. This Privacy Policy describes the types of information that we may collect or you may provide when you use the Game or associated website. This Privacy Policy also describes our practices for using, disclosing, and maintaining such information.

Your use of the Game or our website, initiating a Game-related payment transaction, or accepting this Privacy Policy or our separate Terms of Service each constitute your acceptance of this Privacy Policy. If you do not agree with any part of this Privacy Policy, please discontinue use of the Game and our associated website.

1. Personal Information We Collect. “Personal information” is data that can be used to uniquely identify or contact a single person. We may collect your name, age (birthdate), physical address, email address, cell phone number and IP address or geo-location of the device used to access the Game to permit you to create an account required to be able to play the Game and confirm you are within a permitted location to play the Game while you are accessing it. We also use your contact information in connection with support requests you may make to us or if you make a “contact us” request to us online or via the Game. We will also email interested persons who sign up for our newsletter via the website. You do not need an account to browse general sections of our website providing general information, but to access the Game itself, an account is required.

You will have a user ID and password for the account you create in order to play the Game. Your log-in credentials are private and we do not have access to them. Your player name in the Game, or first name and first letter of last name, may be public visible to other users in the Game if we implement a leader board. You are expected to provide accurate information about yourself to create and maintain an account. You may not impersonate someone else or use a fake identity to create an account, though we recognize that the player names in the Game may be fanciful and not someone’s real name.

To comply with applicable laws limiting where the Game can be played, we cannot make the Game available to users who do not permit us to verify their age and specific geo-location. Location is subject to review for each gaming session. Using a VPN or other technology that masks or changes actual location may result in inability to access to the Game.

We do not process payments in respect of in-Game purchases or withdrawal of U.S. Dollars converted from virtual currencies in the Game that may be deposited in a player’s bank account outside the Game. We have engaged third party payment processors to effect these transactions on behalf of eligible, requesting players of the Game as more particularly described in our Terms of Service. We do not see your payment card or bank account details, or full social security number, which the payment processors may need to collect from you directly (via their own platform) to implement your request. We do have access to and collect the amount of the transaction and the last four digits of your social security number to be able to sync our Game records with the payment transaction amounts. Our current third party payment processors are: Approvely (Privacy Policy - Approvely) and Coinflow (Coinflow Privacy Policy). We may also prepopulate the payment processor’s form for payment transactions you initiate with your contact information, as a convenience to you (using your Account information) when you access the payment portal and start a transaction, but the payment processor will separately verify your identity according to their own legal requirements. We do not see the payment transaction details notwithstanding our ability to share your contact information into the payment request form as a preliminary matter as you cross over to the payment portal operated by the third-party processor.

In the course of operating the Game, information relating to your use of the Game may also be visible to us, such as your purchase history in the Game, and other gaming metrics, such as time spent playing, and what digital currencies or other digital resources you hold. Whenever you interact with the Game, we, as well as our service providers, may use also use assorted technologies that automatically or passively collect data about how the Game is being accessed, used and played. This data will include your specific geo-location as access to the Game is limited in certain locations. It may also include type of device used to access the Game, unique number assigned to identify such device, operating system, your use of features or applications within the Game, and other usage information (“Use Data”). This information helps us administer, manage, improve, secure and customize the Game’s features and functionality and may be used to identify you like personal information.

2. How We Use Information We Collect. We use information we collect, including your personal information and Use Data, to make the Game and our services supporting the Game available, to provide digital assets, services, features and functionality users have requested in or via the Game, communicate about them with users, and support, manage, troubleshoot, protect and improve the Game and our related offerings. We may also use your personal information to send you emails. Fee free to opt out of marketing messages in the individual email, but doing so will not affect our ability to continue to contact you regarding your existing or past gaming relationship with us.

3. Information We Share with Others. We may disclose your personal information to our affiliates and third parties to provide you with what you request (e.g., delivery of Game features and functionality), protect the security and integrity of the Game and our systems, to correct technical problems with the Game, to technically process your information, to provide the Game, and to take precautions against liability. We also may provide your personal information to service providers who provide services on our behalf, such as our data centers hosting the Game, or ask them to collect your personal information on our behalf. We rely on our geo-location service provider GeoComply to help us collect geo-location data, device data and personal information verification for our legal compliance purposes. You may also share your own personal information in the course of accessing the Game. The Game is online. Your online activity in connection with the Game will be transmitted via your mobile carrier’s or internet service provider’s network and your carrier/provider may have access to it. Consult your their privacy policy for additional information. If you are access the Game via a device you do not own and control, such as via an employer’s systems or devices, your use of the Game may be visible to the device or system owner.

We reserve the right to transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business. We reserve the right to disclose any personal information as needed if that information is requested by law enforcement agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity. We also may disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us.

4. Do-Not-Track Requests; Third-Party Tracking. We are unable to give effect to web browser “do not track” signals from users who want to play the Game or on our website. We track specific geo-location for compliance purposes. Third parties, other than our vendors assisting with making the Game available do not have authorization from us to track your uses of the Game or track what other activities you may have engaged in before or after using the Game (for example, using a different website). That said, given the Game is online, we cannot control third-party tracking and there may be some third-party tracking that occurs without our knowledge or consent.

5. Third-Party Links. The Game may contain links to third-party services, apps, and websites that are not controlled by us in any way. Any such links are made available to you as a convenience, and you agree to use the third party offerings at your own risk. Please be aware that we are not responsible for the privacy or business practices or content of such third-party services. Consult their separate privacy policy and terms in regard to their practices.

6. Children. While the Game is a “game,” neither our website nor the Game are directed to children. The Game is not intended for use by people under the age of 18 (or such higher age if the age of majority is higher than 18 where they reside). Accordingly, we do not knowingly collect personal information from children under 13 and if we learn that we have inadvertently collected the personal information of a child under 13, we will take steps to delete the information as soon as possible.

7. Notice to Residents of Countries Outside the United States. We are headquartered in the United States and currently our Game is only intended for individuals located in the United States. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States. We will protect the privacy and security of personal information according to this Privacy Policy regardless of where it is processed or stored.

8. Your California Privacy Rights. Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship what types of personal information, if any, the business shares with third parties for direct marketing purposes by such third parties and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. We do not currently share any personal information with third parties for direct marketing purposes by such parties. A number of states are currently considering enacting laws similar to the California law above. If you are a resident of a state that enacts such a law, please use the contact information above to contact us with any questions, requests or comments.

9. Changes to Privacy Policy. We reserve the right to change or replace this Privacy Policy at our sole discretion at any time and we encourage you to review this Privacy Policy periodically. If we make material changes to this Privacy Policy, we will update the posted version of this Privacy Policy. Any changes to the Privacy Policy will become effective upon posting. Your continued use of the Game following the posting of changes constitutes your agreement to such changes.
